A Lasting Power of Attorney
A traditional power of attorney is a document whereby one person (the grantor) authorises another (their attorney) to act for them in legal or business matters. It enables the attorney to do anything that the grantor could legally do themselves, and is typically used where, for example, the grantor is in hospital, or may be abroad for extended periods. Problems can easily arise however if the grantor were to lose mental capacity, as this would cause the power of attorney to become null and void at a time when it is most needed.
To avoid such difficulties it is now possible, whilst you are in the best position possible, to put specific powers of attorney in place which can be used if capacity is lost. These are known as LPAs and they cover:
